Terms of Service

Welcome to Lead Burst Media LLC ("Company", "we", "our", or "us"). By accessing or using our website and services, you agree to the following Terms of Service. If you do not agree, do not use our services.

1. Services

Lead Burst Media LLC provides marketing and lead generation services, including but not limited to generating inbound inquiries, live transfer calls, exclusive leads, and potential client opportunities for businesses across industries including insurance, mortgage protection, legal, and related verticals.

We may offer exclusive lead distribution in certain markets, where only one client receives leads within a defined geographic area. Availability of exclusivity is limited and not guaranteed unless confirmed in writing.

2. No Guarantee of Results

We do not guarantee any specific results, including but not limited to the number of leads, signed clients, revenue, or return on investment. Performance may vary based on multiple factors outside our control, including your intake process, follow-up speed, pricing, and market conditions.

3. Lead Quality and Responsibility

All leads are provided on a best-effort basis. While we strive to deliver high-intent inquiries, we do not guarantee that any lead will convert into a client or result in revenue.

You are solely responsible for contacting, qualifying, and converting leads, as well as complying with all applicable federal, state, and local laws in your jurisdiction, including but not limited to TCPA, CAN-SPAM, and applicable insurance or financial regulations.

4. Call Recording Disclosure

Lead Burst Media LLC may record inbound and outbound calls for quality assurance, training, and compliance purposes. By engaging with our services, you acknowledge and consent to such recording. Calls may be received from or transferred through our call tracking platform. Some states require all-party consent for call recording; it is your responsibility to ensure compliance with applicable laws in your jurisdiction.

5. Communication Consent

By submitting your information through our website or forms, you consent to receive communications from Lead Burst Media LLC, including phone calls, text messages (SMS/MMS), and emails related to our lead generation services and market availability. Message and data rates may apply. Message frequency varies.

SMS Program: Lead Burst Media LLC operates an SMS messaging program to communicate with life insurance agents and other prospective clients regarding lead generation services, market availability, account follow-up, and related business communications.

Opt-Out: You may opt out of text messages at any time by replying STOP to any message. You will receive one final confirmation message and no further texts will be sent. For email opt-out or other inquiries, contact us at support@leadburstmedia.com.

Help: Reply HELP to any SMS message for assistance, or contact us directly at support@leadburstmedia.com.

No Sharing of SMS Consent: Phone numbers collected for SMS messaging purposes are not shared with, sold, rented, or transferred to third parties or affiliates for their own marketing use, except as necessary to deliver messages through our SMS service provider.

Carrier Disclaimer: Lead Burst Media LLC is not responsible for delayed or undelivered messages. Carriers are not liable for any delays or failures in message delivery.

Age Restriction: Our SMS program is intended for individuals 18 years of age or older. By opting in, you confirm that you are at least 18 years old.

6. Payment Terms

All fees are based on the per-lead or per-call rate confirmed prior to service delivery, as reflected on your invoice. The Lead Burst Media LLC tracking platform (the "LBM Platform") serves as the exclusive source of record for lead volume, call counts, and billing reconciliation. Client-side records, CRM logs, or internal tracking do not supersede LBM Platform records.

Unless otherwise stated in a separate written agreement:

  • Payment is due upon receipt of invoice unless a net payment term has been confirmed in writing.
  • All delivered leads and calls are billable as recorded in the LBM Platform.
  • Payments are non-refundable once leads or services have been delivered.
  • Lead disputes must be submitted in writing within five (5) business days of the invoice date. Disputes submitted after this window will not be considered.
  • Chargebacks or payment reversals that contradict LBM Platform records will be actively contested. Evidence of delivery including call recordings, timestamps, and platform data will be submitted to the payment processor or card network. Confirmed fraudulent chargebacks may result in immediate suspension of services and referral for collections.
  • Late or missed payments may result in suspension or termination of lead delivery without prior notice.

7. Exclusivity

Where applicable, exclusivity is defined as one client per agreed-upon geographic market or vertical. Lead Burst Media LLC reserves the right to define, modify, or revoke exclusivity at its discretion, particularly in cases of non-payment, inactivity, or breach of this agreement.

8. Intellectual Property

All website content, marketing materials, tracking systems, workflows, and processes developed or used by Lead Burst Media LLC remain our sole intellectual property unless otherwise agreed in writing. Nothing in this agreement transfers any ownership interest to the client.

9. Prohibited Use

You agree not to:

  • Use our services for unlawful purposes or in violation of any applicable regulation
  • Misrepresent your identity, business, licensing status, or intended use of leads
  • Engage in abusive, fraudulent, or unethical conduct with leads or consumers provided through our platform
  • Resell, redistribute, or share leads provided by Lead Burst Media LLC without prior written authorization

10. Limitation of Liability

To the fullest extent permitted by law, Lead Burst Media LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of revenue, profits, or business opportunities. Our total aggregate liability for any claim arising under this agreement shall not exceed the total amount paid by you to Lead Burst Media LLC in the thirty (30) days preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lead Burst Media LLC, its members, employees, agents, and contractors from any claims, damages, fines, penalties, or liabilities arising from: (a) your use of our services; (b) your interactions with leads or consumers; (c) your violation of any applicable law or regulation; or (d) your breach of these Terms.

12. Termination

We reserve the right to terminate or suspend access to our services at any time, with or without prior notice, for any reason including but not limited to non-payment, breach of these Terms, or conduct we determine to be harmful to our business or reputation. Outstanding balances remain due upon termination.

13. Changes to Terms

We may update these Terms of Service at any time. The updated version will be posted at leadburstmedia.com/terms with a revised effective date. Continued use of our website or services following any update constitutes your acceptance of the revised terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Sheridan County, Wyoming, unless both parties agree otherwise in writing.

15. Entire Agreement

These Terms, together with any executed service agreement or order form, constitute the entire agreement between you and Lead Burst Media LLC with respect to the subject matter herein, and supersede all prior discussions, representations, or agreements.
